Planning & permissions

Brighton & Hove has extensive conservation areas around the historic centre, Kemp Town, Brunswick, and Hove seafront. Most solar installations on residential properties are permitted development, but listed buildings and some conservation areas may require planning approval — a listed building needs Listed Building Consent in addition to any planning permission, which in practice usually means a rear-roof layout with all-black, low-profile modules. Converted flats are a separate question again: the roof is shared, so we confirm freeholder consent and the roof rights before designing anything. Our surveyors check all of this during the initial site visit and handle any applications on your behalf. Properties within the South Downs National Park (north of the city, above the A27) may also need notification.

Planning for solar in Brighton and Hove

Brighton and Hove City Council is the local planning authority for the city, except where a property is inside the South Downs National Park. Since 1 April 2012 the National Park Authority has dealt with all planning applications, pre-application enquiries and enforcement in the Park part of the city.

Most solar panels on a house are permitted development. The rules are in Class A, Part 14, Schedule 2 of the General Permitted Development Order. Panels must not stick out more than 0.2 metres from the roof slope, must not sit higher than the highest part of the roof apart from the chimney, and must be sited to keep their effect on the building and the area as small as possible. Class A does not apply at all if your home is listed, and listed building consent is needed for work that affects a listed building's character.

The city has 34 conservation areas. Its Article 4 directions list, dated 22 September 2021, names 49 of them. In a conservation area you cannot put panels on a wall, balcony or roof enclosure fronting a highway, and for a flat roof array you must first ask the council whether its prior approval is needed for how the panels will look, before work starts.

If your home is in the South Downs National Park

The National Park boundary runs through this part of East Sussex. Where a property is inside it, the South Downs National Park Authority is the planning authority, not the district or borough council. Its Planning Committee is the statutory planning authority for the Park.

The Authority says the General Permitted Development Order still allows microgeneration on homes, including solar panels, where the conditions in Part 14 are met. Its own advice note says sensitively designed roof top solar is likely to be suitable in most areas, and that making use of existing roof space is strongly encouraged. It also says several Part 14 rights do not apply to listed buildings or to land and buildings in their grounds, that there are restrictions relating to conservation areas, and that anyone affected should get tailored advice.

A National Park counts as article 2(3) land, so for a flat roof array you must first ask the Authority whether its prior approval is needed for how the panels will look, before work starts.

After getting a number of different quotes, from expensive through to outrageous, I came across Eastbourne Energy. It was Saturday, I put my details in the online form asking if he would travel to Portslade and I was pleasantly surprised to receive a call from Lee, the director. We chatted about different solutions, options and his quote arrived within 24 hours. No pushy sales, he didn’t try to upsell me anything, advised (correctly) that I didn’t need a bigger battery due to my low usage and I got a positive vibe from him. No pushy sales! Yes, I’ve said it twice! None of those dodgy sales tactics, like another vendor tried. From the scaffolding team, the installers, electricians and finally the wizard himself (Lee!) turning up to commission it all - it was an easy journey. Nothing was too difficult for them, they were able to answer my questions, walked me through the install and plying them with coffee, they completed my install in a quick and incident-free fashion. Very professional, all round. I was “that guy” and I did ask for something to be moved - no problem at all. I now have a maximum of 7.2kW across two roofs, getting the morning sun to charge the battery and midday/afternoon sun to sell back to the grid. If I could give Eastbourne Energy more than 5 stars I would. I highly, highly recommend them. I cannot sing their praises highly enough. All so easy and stress free from start to finish, absolutely everything is taken care of. I just made tea and coffee! The team, consisting of Lee, Phil, Josh, Jordan, James and Ollie, are all incredibly lovely guys. They are all very professional, polite, and friendly. They were all a pleasure to have around for 2 days. The guys turned up when they said they would and the installation took the time I had been told it would take. They all did a first class job, the cable work is so neat and tidy, with cables being hidden where possible. The positioning of the batteries and inverter were discussed with me before they were installed to ensure I was happy with everything. Everything was left clean and tidy at the end of the first day and after the installation had been completed on the second day. Lee dealt with all the paperwork I needed and commissioned everything at the end of the installation. He made sure everything was working properly, installed the app I needed on my phone and kept an eye on my system for a couple of days to ensure there were no problems.
